ONLINE DISPUTE AS A TOOL FOR CITIZENSHIP AND THE FACILITATION OF ACCESS TO JUSTICE

Abstract

Today's society is marked by rapid and constant transformations, many of them determined by technological development. Diversities that relate to conflicts are also growing because of the multiple kinds of relationships that are dealt with on a daily basis, including by virtual interaction. On the other hand, seeking efficient responses to the social need for pacification, and within the limits of the effective management of this range of conflicts by the Judiciary, at least in its traditional format, the "Alternative Dispute Resolution" (ADR) most recently proposed, the "Appropriate Dispute Resolution". Thus, what has been called the multi door court house  model of conflict resolution has been developed, through which a number of ways are available - "doors" for the referral of the conflict, both judicially and extrajudicially. In this evolutionary line, and also by the influence of new technologies, in particular online and new patterns of behavior generated, we can observe the growth of the Online Dispute Resolution (ODR) methods, online negotiation platforms, assisted or not by third parties, that allow the resolution of conflicts arising from virtual interaction (e-commerce, etc.), withe reduced burcaucray and efficient. This essay is intended for some consideration of this new reality.
