THE INTERNATIONAL ENVIRONMENTAL PROTECTION SYSTEM: BRIEF REFLECTIONS ON THE CONSTRUCTION AND CHALLENGES OF THE PARADIGM OF NATURE’S RIGHTS

Abstract

The present work proposes the systematization of international metaindividual environmental norms, with a view to analyzing the construction and the challenges of possible solutions to serious contemporary environmental problems, with the proposal to build a paradigm shift for Nature’s rights. The methodology used is systematic with bibliographic research. First, the international environmental protection system was introduced. Then, there is an analysis of the effectiveness of the Sustainable Development Agendas. Finally, the main proposals for changing this system’s paradigm in the contemporary world and Brazil were discussed. It is concluded that the international system of environmental protection is advancing and changing the standarts in the world. It is also possible to conclude that the Development Agendas propose international standarts to the States. It remains clear that this global normative system is advancing, with the implementation of a system built under the aegis of a new paradigm. However, there were some challenges to be faced, through the efforts of States, to maintain the high international level of protection of the environment. Finally, most of the proposed changes attempt to apply the logic of the Constitutions of the Americas, global legislation and UN standarts, such as Harmony with Nature, with the recognition of the rights of Nature.
