DISCURSO DE ÓDIO: SIGNIFICADO E REGULAÇÃO JURÍDICA

O discurso de ódio representa uma ofensa dirigida a um grupo de indivíduos em razão de seu gênero, raça, religião, orientação sexual etc. O problema central de regular juridicamente o discurso de ódio é como impor proibições sem limitar excessivamente a liberdade de expressão, princípio fundamental das democracias ocidentais contemporâneas. As normas jurídicas destinadas a regular o discurso de ódio devem ser elaboradas a partir do significado do termo “discurso de ódio” que não é pacífico na doutrina. O objetivo deste artigo é contribuir para a reflexão jus-filosófica sobre o termo discurso de ódio. Primeiramente, apresentar-se-ão os principais debates referentes ao discurso de ódio, visando a analisar como tais debates têm influenciado o direito brasileiro sobre a matéria. Utilizando o método de abordagem dialético e os métodos de procedimento analítico e comparativo, concluiu-se que, apesar de não existir uma legislação específica no Brasil que cuida do tema, há diversas regras jurídicas, projetos de lei e jurisprudência que tratam do discurso de ódio de uma forma semelhante à apresentada por Jeremy Waldron.
