COLLECTIVE WRIT OF MANDAMUS CONCERNING TAX MATTERS AND TAX OFFSETTING: THE NECESSITY TO MAKE THE REPETITIVE THEME 118 COMPATIBLE TO TAX CLASS ACTIONS.

This article aimed to analyze whether or not the Repetitive Theme n. 118 is compatible with collective writs of mandamus concerning tax matters. The first step of this analysis was ascertaining out the origins of the Repetitive Theme n. 118, which prescribes that writs of mandamus meaning to declare the right of the taxpayer to offset a tax declared illegal or unconstitutional must be filed with the payment receipts of such tax. Then, the article studied if this condition is compatible with the specificities of spurious class actions. To do so, the article studied the nature of associations and class entities legitimacy to sue according to the Brazilian law and the need that the common aspects of the conflict prevail over its individual aspects to make it possible for spurious class actions to be filed instead of individual actions. After analyzing all these aspects, the conclusion of this study was that the Repetitive Theme n. 118 is not compatible with the collective writ of mandamus.
