PROCESOS COLECTIVOS EN EL NUEVO CÓDIGO CÓDIGO PROCESAL PARA LA JUSTICIA EN LAS RELACIONES DE CONSUMO DE LA CIUDAD AUTÓNOMA DE BUENOS AIRES

Abstract

En este trabajo realizaremos una primera lectura de la regulación sobre procesos colectivos de consumo establecida en el Capítulo 4 del Código Procesal para la Justicia en las Relaciones de Consumo (en adelante “el Código”) sancionado el 11 de marzo de 2021 como Anexo A de la Ley N° 6.407 de la Ciudad de Buenos Aires.[1]

Según veremos, se trata de una normativa que significa importantes avances en términos de previsibilidad, acceso a la justicia y debido proceso colectivo, aunque también contempla previsiones que configuran un retroceso para esos mismos derechos y garantías y que plantean cuestiones problemáticas en términos constitucionales.
