Abstract

The purpose of this article is to find a better understanding of the relationships between state, society, and religion. Seek an interpretation of the principle of secularism, considering the principle of human dignity and its corollary, the principle of fraternity. An investigation will be implemented to verify whether the principle of religious freedom - constitutionally foreseen - may suffer from misuse by the State and society, presenting practical aspects for analysis, aiming at the modes of application of the principle, respecting the most varied creeds. An initial work will be, from the legal aspect to study how these principles were systematically included in the 1988 Constitution, as fundamental elements for the conception of a democratic State of law. As for the methodology, the work was elaborated based on hermeneutic procedures of analysis and interpretation of doctrinal, legislative, and jurisprudential texts, resorting to historical and comparative study, with a view to adequate understanding of the themes reflected.

Professor na Faculdade de Direito; fez graduação, Mestrado, Doutorado em Filosofia do Direito e foi Chefe de Gabinete na Pontifícia Universidade Católica de São Paulo, SP. Foi Pró-Reitor de Pós-Graduação, Pesquisa e Extensão, Coordenador do Mestrado em Direito e professor no UNIVEM. Líder do Grupo de Pesquisa GEDs - Direitos Fundamentais à Luz da Doutrina Social, cadastrado no CNPq. Foi líder do Grupo de Pesquisa: GEP Grupo de Estudos e Pesquisas - Direito e Fraternidade. Membro fundador do NEDs - Núcleo de Estudos de Doutrina Social - PUC-SP. Editor Científico da Revista DDEM. Membro do Conselho Editorial da Revista de Direito Brasileira - RDBras, do CONPEDI e da Clássica Editora. Avaliador para cursos de direito INEP/MEC. Master in Law from the Eurípides de Marília University Center (2011); Graduated in Law from Centro Universitário Eurípides de Marília (2008); Lawyer registered with the OAB under nº 293.996 (2009); Expert Expertise in Real Estate Appraisals (2010); Real Estate Translation Technician registered with CRECI under nº 72.571 (2006). Real Estate Appraiser registered with COFECI under CNAI nº 42.993 (2023). He is currently a professor at Faculdade Católica Paulista (UCA) and in the courses of Legal Services, Technician in Administration, Technician in Accounting, NOVOTEC's at ETEC Antônio Devisate and Coordinator of the Technical Course in Administration of Novotec Integrado at ETEC Antônio Devisate in partnership with Escola Estadual Amélia Lopes Anders. He was Coordinator of the decentralized Novotec-Administration Course at ETEC Antônio Devisate in partnership with the Amilcare Mattei School (2022). He was a professor in the Administration Course at the Faculty of Higher Education of the Interior Paulista (FAIP / Faef Group). He was Professor and Coordinator of the Law Course at Faculdade Santo Agostinho de Sete Lagoas-FASASETE / Grupo Afya Educacional (from 2014 to 2020). He was Professor and Coordinator of the Law Course at the Faculty of Science and Technology of Unaí-FACTU (from 2011 to 2013). He has experience in the area of Law, Teaching and Higher Education Management with special emphasis on the production of PPC, regulations and in Authorization, Recognition, Accreditation and Re-accreditation processes. Teaching activities with emphasis on Theories of Law, Theories of the State and History of Law, working mainly on the following topics: Human Dignity, Constitutional Principles, Principles of Procedure and History of Law.
