THE INCORPORATION OF HUMAN RIGHTS TREATIES AT THE BRAZILIAN LAW
Abstract
ABSTRACT
The goal in the subsequent article is to bring acknowlegde obout the incorporation procedure of the human rights treaties in the native judicial order, such as the contemporary comprehension of the hierarquy modalities in this human rights rules resulted from international treaties in the brazilian law. By these terms, as the paper occurs there will be a approach through the theoretical doctrine controversys showing the consolidated agreement made by Brasil’s Federal Court of Justice with focus on the Constitutional Amendment n° 45/2004. To conclude, there will be a analysis about the procedure used to get the approval of the Convention on the Rights of Person with Disabilities (CRPD) and its Optional Protocol signed at New York on the thirtieth of may in 2007. To achieve the expected results a bilbiographical research metodology was used through the reading of doctrinal work, cientific articles, jurisprudences and pertinent legislations regarding the theme. Based on the considerations above, there will be presented to the conclusion the incorporaton procedure of international human rights rules compared to the agreement used at the Federal Court of Justice.
