Abstract

The present work aims to observe the progress of technology, analyzing society and the legal system in all phases of the Industrial Revolution, until reaching Industry 4.0, since this is the central point of the biggest current deliberations. In this sense, it will discuss the civil liability of entities equipped with Artificial Intelligence, since they do not have legal personification, but can still perform acts similar to those of a human person. As well as, the application of Digital Law in cases where the problem is no longer with the entities or developers of this technology themselves, but with the people who make inappropriate use of Artificial Intelligence by Deepfake, contributing to disinformation, data manipulation, crimes against honor and even threats to the democratic state.

Fabiana de Paula Lima Isaac Mattaraia, Universidade de Ribeirão Preto

Master's student at the Master's Program at the University of Ribeirão Preto / SP; University Professor of Law at the University of Ribeirão Preto / SP - UNAERP on matters of Civil Procedure, General Theory of Process and Forensic Medicine and Bioethics; from the Graduate Program in Business Law and Civil Procedure at EBJUR, and from Corporate Law at IPEBJ in the Graduate Program in Medical Law and courses at the Escola Superior de Advocacia (ESA) in Ribeirão Preto / SP. Lawyer (since 2006) working in areas related to Corporate Law; through its own office since 2011 and through the Rivalta de Barros office since July 2020. Specialist in Business Law from the Continuing Education and Specialization in Law Program GVlaw SP and Graduated from the University of Ribeirão Preto / SP. Arbitrator at the Ribeirão Preto Mediation and Arbitration Chamber since 2020 - CMARP.

Sebastião Sérgio da Silveira, Universidade de Ribeirão Preto

Graduated in Legal Sciences from the University of Ribeirão Preto (1984), Masters in Law from the Pontifical Catholic University of São Paulo (1999); PhD in Law from the Pontifical Catholic University of São Paulo (2004) and Post-Doctorate from the Faculty of Law of the University of Coimbra-Portugal (2011). He is currently the 8th Public Prosecutor of Ribeirão Preto, of the Public Ministry of the State of São Paulo; Full Professor at the University of Ribeirão Preto, where he is Coordinator of the Course and Postgraduate Course in Law and Professor of the Department of Public Law at the Faculty of Law of Ribeirão Preto, University of São Paulo - FDRP-USP. Honorary Professor at the Faculty of Law at the Universidad San Martin de Porres - Lima - Peru. From March 2011 to 2016, he was a member of the State Executive Committee of the National Forum of the Judiciary for Health, of the National Council of Justice - CNJ. Chief Editor of Paradigma Magazine and Reflexão e Crítica do Direito Magazine. Collaborating Member of the National Inspectorate of the Public Ministry, of the National Council of Justice from 10/28/2022 to 02/06/2024. He has experience in the area of Law, working mainly on the following topics: misconduct; public civil action, environment, third sector, public health, children and youth, citizenship and criminal proceedings.
