Abstract

This article proposes to analyze on the main changes regarding special retirement due to exposure to harmful agents in the context of the Brazilian Social Security Reform (Constitutional Amendment 103/19). To this end, the bibliographic-documental research method is used, with doctrinal and jurisprudential support, in order to list the main changes brought about by the Amendment, demonstrating, in a practical way, how it reflects in the lives of workers. Finally, it is concluded that the criteria consolidated in the  Reform brought a social setback for the retirement of workers exposed to harmful agents, violating basic principles of the national legal system, such as the principles of non-setback and the dignity of the human person , annihilating essential nuclei of social law already in effect, such as the right to social security protection for insured persons exposed to harmful agents.
