COMPROVAÇÃO DA ATIVIDADE RURAL PARA APOSENTADORIA DOS TRABALHADORES RURAIS DA COMUNIDADE “LINHA DA MUMBUCA: A LEI AMPARA OU FAZ REFÉNS?

Abstract

This article aimed to analyze the confrontation of rural workers in the granting of rural retirement, due to the difficulty of proving the rural activity performed with the National Institute of Social Security - INSS. The rural worker contributes directly and indirectly to the support of Brazilian families, as well as to the country's economic and social development and growth. To this end, a survey was carried out in the “Linha da Mumbuca” community in the Municipality of Passo, State of Minas Gerais, Brazil, where it was possible to identify that rural workers are hostages of informality and, therefore, are unable to meet the bureaucratic requirements of the law, which prevents the granting of the benefit. We sought to analyze the social security legislation and the object of Bill 268/2022, as a way to enable the proof of the referred activity to grant the rural worker's retirement. It was found that, despite the attempt of the law to protect and support, alone it is not effective, depending on other means, such as the work of the Public Ministry and Unions, so that it is possible to protect the rural worker in the course of his activity and at the same time. end of it, with the concession of the benefit.
