The OVERINDEBTEDNESS OF THE ELDERLY POPULATION IN CONSUMER RELATIONSHIPS IN LIGHT OF THE PRINCIPLE OF VULNERABILITY

Study about the prediction, interpretation, application, and effectiveness of the principle of vulnerability concerning the elderly population in consumer relations. Thus, analyzed the foundations and aspects of this principle regarding the current consumer Society context in which the elderly are involved. The accomplishment of this research is justified by the possibility of mitigatinh the overindebtedness and cicil insolvency of this portion of the population through a serious and genuine examination of vulnerability concerning consumption and their contexto. This can be achieved using the new provisions introduced in Law nº 10.741 of 2002 (Elderly Statute) through Law nº 14.181 of 2021. The methodology employed was bibliographic research, based on relevant authors who address the subject. Furthermore, na exploratory approach was folowed, involving the analysis of legal texts and emblematic cases.
