Abstract

This article aims to build a knowledge base regarding the comparison of assistance benefits in Brazil and Chile for the elderly, the benefit that in both countries aims to provide a life with dignity for a portion of the population - the elderly - who do not have condition to survive without this government assistance. In this article, the methodology used was the doctrinal analysis of the legislation on the benefit of continuous provision in Brazil for the elderly and los aportes solidarios in Chile. Being studied, therefore, from its imprecise origin in Europe, the insertion in the Brazilian legal system until its current evolution with the new interpretative profiles of the STF and the los aportes solidarios in Chile, its requirements and the comparisons with the Brazilian assistance benefit. The current benefit in Brazil and Chile aims to provide the elderly with an allowance. In the study of this benefit, in addition to the historical part, the subjects of this legal relationship, the requirements for receiving it (elderly beneficiaries), the purpose of the benefit, financing, economic hyposufficiency, proof of poverty, addressed what constitutes one of the basic principles of the Federative Republic of Brazil of human dignity and the understanding of the courts on the subject. In this way, the theme is delimited with the study of the benefit of continuous provision and the solidary contributions in Chile, for elderly people.
