Abstract

Currently, the rates of the Brazilian prison population are alarming, and this is reflected in the social security system through the granting of incarceration benefits. The current Constitution of the Federative Republic of Brazil was enacted on October 5, 1988. It establishes Brazil as a democratic state governed by the rule of law and was designed to demonstrate the change taking place in the Brazilian governmental system, which had emerged from an authoritarian regime that lasted for more than two decades.

With regard to the guidelines on Social Security, it is important to emphasize that the Constitution provides Chapter II, Title VII, entitled “Social Order,” to address Social Security. “Social security consists of an integrated set of actions initiated by the public authorities and society, aimed at ensuring rights related to health, welfare, and social assistance.” Thus, there is a clear need to legislate on Social Security, with reference to health care, welfare, and social assistance — a recognition of the needs that could ensure the quality of life of Brazilian citizens.
