A AÇÃO CIVIL PÚBLICA NA TUTELA DO PATRIMÔNIO CULTURAL EDIFICADO: DOIS EXEMPLOS DE ATUAÇÃO DO MINISTÉRIO PÚBLICO DE MINAS GERAIS NA COMARCA DE ARAXÁ

Abstract

The collective action is essential to transindividual rights protection, given the scope of current conflicts and the solutions that must be conferred to collective demands. In the context of the protection of collective rights, there is the protection conferred by environmental law to built goods that express the memory, culture and values ​​of populations. Thus, as a niche of environmental law, there is the law of cultural heritage, which, in addition to using the protective rules of environmental law, its elements, concepts and principles proper to the protection of the collective good, finds support in procedural law, based on the elements of the collective action. The present work aims to narrate the ministerial action in the management of public civil action as an instrument of protection of two built heritage assets, located in Araxá County, in the Estate of Minas Gerais. Specific objectives include identifythe protection of cultural heritage conferred by law, the procedural normative protection conferred on cultural heritage through collective action, and the ministerial action in relation to the legal protection of two buildings located in Araxá County. The methodology employed comprises the bibliographic review and the case study. Therefore, the ministerial agency's action is taken as a parameter in the face of two specific demands.The expected results demonstrate the effectiveness of public civil action as an instrument for the protection of built assets belonging to the cultural heritage.
