Abstract

In times of crisis, it is necessary to be aware, in the long run, of the measures to be taken to mitigate the damage. Thus, in the face of the COVID-19 pandemic and its impact on jurisdictional provision, the procedural legal business instrument is seen as a necessary tool for obtaining fair and effective decisions in times of precariousness. It is not intended to point out a single path to be followed and obeyed, or even to exhaust the topic, but rather to generate a reflection on what would be the procedural negotiation and how it can be developed in favor of a procedural dynamic attentive to reality. parties and their interests, observing the constitutional dictates of protection of rights. The methodology was carried out from the study of the literature on the subject, as well as the related jurisprudential advance.
