THE JUDICIAL POWER AS A REPRODUCING SOURCE OF RACISM AND THE DEMOCRATIC STATE OF LAW
Abstract
This article aims to discuss the problem of the Brazilian judiciary as a mechanism for the creation and reproduction of racism, its selective performance, as well as its non-performance as a guarantor of rights to black people. In this way, we will analyze two concrete cases, of great repercussion, that will serve as a guide for all our work. We will approach the concept of race as a political factor, the exorbitant number of black people in prisons, the whiteness that makes up the Brazilian judiciary, as well as the injustices committed by black people due to the lack of representation. It is also the object of this work to analyze the democratic rule of law in the face of social inequalities, its role and the slow path to real democracy. In this perspective, it sought to bring effective and quick solutions that can contribute to changing this sad scenario that has been perpetuating over time. The work is composed of the qualitative and quantitative variables, and does not claim to exhaust the entire theme.
