THE IMPRESCRITIBILITY THESIS OF ENVIRONMENTAL DAMAGE IN GENERAL REPERCUSSION OF THE SUPREME FEDERAL COURT AND THE POSSIBILITY OF APPLYING THE AGGRAVATED RISK THEORY ON DIFFUSE RIGHTS
Abstract
The purpose of this article is to analyze the right to informational self-determination, a fundamental and personality right, and the protection of the user's personal data in the virtual environment, in view of the possibility of creating informational profiles and serving behavioral advertising. For this, the work used the hypothetical-deductive method, based on research and bibliographic review of works, periodical articles, legislation, doctrine and jurisprudence applicable to the case. As a result, it was found that the creation of informational profiles and the transmission of behavioral advertising is increasingly frequent in the virtual environment, through the collection and treatment of the user's personal data. In this sense, it is essential that the user has knowledge and consents about this context, in order to have their privacy, personal data and their right to informational self-determination respected, especially in view of the possibility of leakage and sharing of information with private companies and with the State.
