PARENTAL ALIENATION SYNDROME: A CRITICAL ANALYSIS OF LAW 12.318/2020 AND ITS EFFECTIVENESS ON APPLICABILITY BY BRAZILIAN JUDICIAL POWER
Abstract
The present work was developed with the objective of analyzing Law 12,318 of August 26, 2010, which regulates the Parental Alienation Syndrome. Such a theme, considered recent in positive Brazilian law, has been a phenomenon that has been present for some time, and has been the subject of numerous citations of Brazilian jurisprudence and doctrine. For a better understanding of its origin, it was necessary to understand the evolution of the family institute. In earlier times, the responsibility for the care and education of the children was delegated to the mother, while the father exercised the role of sole provider of the home. In contemporary families, however, there is a distancing of women from the family and their inclusion in the job market, which made the family scenario different, thus changing family rules.
