A A PROTEÇÃO DO CONSUMIDOR NO PLANO SUBNACIONAL: LIMITES FEDERATIVOS E A POSSIBILIDADE DE COMPARAÇÃO DOS REGIMES ESTADUAIS DE PROTEÇÃO AO CONSUMIDOR

Abstract

The present article seeks to discuss the possibility for member states to discipline and uphold the fundamental right of the consumer through state constitutions. The problem presented is the feasibility of dealing with fundamental consumer rights at the subnational level, because if Brazil is a federalist country with a division of competences that involves the legislature acting in the production of law, then consumer protection must be provided for in state constitutions is not an exclusive theme of the National Congress.
