Abstract

The present study has as its theme the constitutional positivation of fundamental rights and the principle of the dignity of the human person to the private individual of freedom. It is delimit in analyzing the (in) applicability of the constitutional positivation of the fundamental rights of the individual in the system of deprivation of liberty and its implication in the conditions of (IM) possibility of overcoming the delinquent stigma, as well as in Attempted withdrawal of criminal recurrence. The research will be based on the following question: To what extent the (in) applicability of fundamental rights constitutionally positivized to individuals sentenced to deprivation of liberty can offer conditions of (IM) possibility of overcoming Of the delinquent stigma and the removal of the prison? Objective with the study to analyze whether the fundamental rights and dignity of the human person are being guaranteed to segregated individuals, as well as to analyze the characteristics of the prison system, any violations of rights suffered by Incarcerated and if the prison system offers conditions for the removal of the individual from delinquency and suplantation of the stigma of delinquent attributed to him. The methodology employs the hypothetical deductive.
