A (IN) EFICÁCIA DAS POLÍTICAS PÚBLICAS: COMENTÁRIOS ATUAIS A RESPEITO DA GARANTIA DO DIREITO FUNDAMENTAL À SAÚDE DOS USUÁRIOS DE DROGAS

Abstract

Brazil, like many other countries in the world, is experiencing a very serious public health problem caused by the use of illicit drugs by a significant part of its population. Several consequences have arisen from the problem. The main one concerns the true legions of people who roam the public thoroughfares of the big cities, completely unassisted, with negative repercussions of all order. The Brazilian State, on the other hand, was unable to implement public policies to confront the problem. In the year 2001, a psychiatric reform was instituted through a federal law, which sought to eliminate the manicomial culture. However, what can still be verified in practice is that the values and benefits recommended by the Law were not implemented. In addition, due to the current legislative changes, it is observed that the guidelines for the treatment of drug users have been modified, given the negative results of the protocol previously followed. Regarding such a modification, there are opposing positions of the professionals of the subject, which shows that there is still no consensus as to how this problem can be managed by the Brazilian State. As a result, the prospect is that the membership will increase due to the situation. Therefore, the present work proposes a brief analysis of the legal repercussions, demonstrating some of the problems arising from the inefficacy of such Public Policies.
