Abstract

In this paper, we make a critical analysis on the judicialization of health in Brazil, from the perspective of evidence-based medicine. We will examine the foundations of the right to health in the 1988 Federal Constitution. We will also see the commitment of Evidence-Based Medicine to the full realization of health in public management. Finally, we will know the relationship between Justice and Evidence-Based Medicine, considering the judicialization of health, also examining the jurisprudence around the subject. To this end, the deductive method and procedure of bibliographic and documentary research will be used, the latter focusing on the jurisprudence of the National Council of Justice, the Superior Court of Justice and the Supreme Court.

The expected contribution to the article is to overstate the importance of scientific support for the judicial decision.
