Title: TIC, TELEWORKING AND DIGITAL DISCONNECTION: NECESSARY BALANCE TO PRESERVE HEALTH AND AVOID NEW PATHOLOGIES OF A PROFESSIONAL CHARACTER
Abstract: Technological advances associated with the digital world have brought with them significant occupational risks for workers, derived mainly from the massive incorporation of information and communication technologies in their activities. This can be translated into the appearance of modern professional contingencies as a consequence, for example, of the use of flexible work formulas (teleworking) or the absence of an effective digital disconnection (blurring the separation between work and rest times). This scenario forces the legislator to grant a specific protection, which has resulted in provisions such as Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of Digital Rights, or the most recent Royal Decree- Law 28/2020, of September 22, regarding distance work. Despite everything, the final result seems unsatisfactory and inefficient, as there are many aspects that can be improved.
