LEGAL DOGMATISM AND HUNGER IN BRAZIL: FROM THE CONTRADICTIONS OF DOGMATIC DISCOURSE TO THE FACTICITY OF THE RIGHT TO FOOD
Abstract
In a world of persistent contradictions, the challenges faced in the 21st century by groups in situations of vulnerability are unequally unequal and the system of thought that is not subject to criticism contributes to their intensification. It is discussed, from a legal analysis, two levels of approach: one at a formal level, from the criticism made by Warat and, another, material, related to the approach of the right to food and hunger in the Brazil. The research is developed, therefore, with the objective of reconciling a critical aspect to radical dogmatism, whose doctrine welcomes the opening of meanings as a condition of possibility, making the analysis of the material aspect of work (hunger) not an object of rationalization, but as a natural element intrinsic to every living being. Thus, the research is carried out using the deductive method, with literature review and data analysis.
