Abstract

This work aims to deal with the Accident of Trajectory in the Brazilian legal system, from its standardization in Law No. 8,213/91 (Social Security Law), to its theoretical/doctrinal basis and pragmatic use in the daily life of law operators. With this, it will be versed on its classic hermeneutics of the commuting accident with taxative list, the need for a new hermeneutics with exemplary list and the emergence of a legislative change. Finally, the work will demonstrate that the understanding currently standardized on Accident of Trajectory with taxative list is flawed and needs a renewal in order for Brazilian legislation to protect the social right of workers.
