The inclusion of people with disabilities in Brazilian social assistance and social security is the subject of analysis in this article. It seeks to answer the following question: is it possible for citizens with disabilities to overcome legislative obstacles and be effectively included in the Brazilian social protection system, within the scope of social assistance and social security? To this end, the deductive method is adopted, starting from general premises and reaching specific conclusions, through a historical and bibliographical survey and a dialogue between Constitutional Law and Social Security Law. The study focuses on analyzing the legal microsystem that protects the community of people with disabilities, as well as related doctrine and jurisprudence. The research aims to foster academic and social debate about the existence of legislative barriers and the possibility of overcoming them based on normative, doctrinal, and jurisprudential developments, favoring the effective inclusion of these individuals in the social security and assistance systems in Brazil.
