ALTERNATIVE DISPUTE RESOLUTION IN ACCESS TO JUSTICE:

Abstract

This article deals with the question around alternative dispute resolution inserted in the paradigmatic change of access to justice in Brazil. It is discussed whether the use of alternative dispute resolution is an opportunity for advocacy of the effective access to justice. The object of the research is the strategic opportunities that were created over the years when the national legal framework for alternative dispute resolution was edited. We use the hypothetical-deductive method and the descriptive, documentary and bibliographic techniques. Conclusion: alternative dispute resolution are excellent opportunities for lawyers and law firms to develop negotiating skills and to realize the fundamental right to access justice.
