Abstract

The Coronavirus (SARS-COV), or better known as COVID-19, is a disease that has spread worldwide, presenting itself in a fast and lethal way that, in the face of a very strong pandemic of the Ministry of Health, thought of some groups at greater risk , among these groups, are pregnant and postpartum women. For these reasons, it was necessary to adopt measures to protect pregnant women and the fetus. This is a bibliographic study with a research approach by the deductive and logical method, through analytical reading of the typographic of the Ministry of Health, edition of Laws by the Legislative Power, jurisprudential and doctrinal understanding. Doing physical and mental work in the face of human health from COVID-19, causing the guarantee of protection in the person's employment relationship, the principle of protection of work from work to work of fundamental rights, as these rights principles serve to protect- Therefore, because the worker is the most fragile and dependent part of the employment relationship, it is for this reason that extreme consideration and the health of the worker must be taken into account in all criteria. This work will explain about the vulnerability of the health of the pregnant employee based on those published by the Ministry of Health as laws enacted during the pandemic period. Bringing a critique of the approach used by the Legislative Power to deal with a problem.
