O REGIME JURÍDICO DIFERENCIADO DOS CONTRATOS ADMINISTRATIVOS NA ADMINISTRAÇÃO PÚBLICA INDIRETA: DESAFIOS E PERSPECTIVAS
Abstract
This article delves into the world of administrative contracts in the Indirect Public Administration, focusing on Public Companies and Mixed Economy Companies that carry out economic activities. In accordance with the Federal Constitution, these entities enjoy a contracting and monitoring regime that is distinct from the more bureaucratic process of Law 8.666/93. The nature and formality of contracts gain crucial relevance, shaping the modalities of drafting and developing the contractual process. These modalities, predetermined and specified by law, are subject to the principle of legality, which guides the actions of public administrators. Contractual amendments, the forms of application of fines and the mechanisms for contract termination also have well-defined legal limits. Furthermore, rigorous monitoring of these contracts is an essential tool for preventing and combating corruption, ensuring transparency and ethics in relations between the Public Administration and companies.
