CITIZENSHIP (RE) CONSTRUCTION AND PACIFICATION IN JUDICIALIZED SOCIAL WELFARE

Abstract

One of the main foundations of the Welfare State is to contribute to the most unfortunate in the defense of equality from governmental programs and social benefits. However, after the enactment of the Constitution of Federative Republic of Brazil the 1988 and the extension of social rights, there is an excess of lawsuits. This article analyzes the crisis of the Constitutional State of Social Welfare and the scrambling of state functions in the face of the protagonism exercised by the Judiciary, through the possible hypotheses of increasing the judicialization of social relations, in order to (re) construct the meaning of citizenship in the search for social pacification.

Doutor em Direito Constitucional pela Universidad de Valladolid, ES, Professor de Direito Constitucional da Universidade Regional Integrada do Alto Uruguai e das Missões – URI (Graduação e Mestrado/Doutorado), e da Faculdade Cenecista de Santo Ângelo (IESA), Santo Ângelo/RS. Coordena o projeto de pesquisa “Estado, Constituição, Diferença: olhares críticos sobre a diversidade no constitucionalismo”, é líder do Grupo de Pesquisa “Direitos de Minorias, Movimentos Sociais e Políticas Públicas”, com registro no CNPQ, vinculado ao Mestrado/Doutorado em Direito da URI/Santo Ângelo/RS. Procurador da República. Autor dos livros “Constituição: reformar para que(m)”, “Inviolabilidade parlamentar: do senador ao vereador”, publicados pela Editora Livraria do Advogado, “Constituição: um olhar sobre minorias vinculadas à Seguridade Social” (em coautoria com Jane Berwanger), “Indígenas no Brasil: (In)Visibilidade Social e Jurídica” (em coautoria com Ederson Nadir Pires Dornelles e Fabiano Prado de Brum), publicados pela Editora Juruá.

Mestre em Direito pelo Programa de Pós-Graduação stricto sensu – Mestrado e Doutorado em Direito da Universidade Regional Integrada do Alto Uruguai e das Missões (URI) - Campus de Santo Ângelo (RS). Especialista em Docência na Educação Profissional Técnica e Tecnológica pelo Instituto Federal Farroupilha - Campus Alegrete (RS). Auditora do Instituto Federal Farroupilha. Membro do Grupo de Pesquisa registrado no CNPq: Direitos de Minorias, Movimentos Sociais e Políticas Públicas.
