THE WORKLOAD OF BASIC EDUCATION TEACHERS AND THE VIOLATION OF CONSTITUTIONAL RIGHTS TO HUMAN DIGNITY, HEALTH, AND DECENT WORK

A teacher's working day goes far beyond the time spent in the classroom. Therefore, this article aims to analyze whether the working hours practiced by basic education teachers enforce the constitutional rights of human dignity, health and decent work. The approach method used will be deductive and the research technique will be indirect documentation through bibliographical consultation in books, periodicals, scientific articles and magazines qualified for the topic, in addition to the relevant Brazilian legislation. Through this research, it was concluded that, in most cases, the working day practiced by basic education teachers, due to its intensity and length, added to the non-disconnection with work, does not implement the constitutional precept of dignity of the human person, while it harms the teacher's health and the social right to decent work. When analyzing the work of basic education teachers from the perspective of human dignity and the constitutional rights to health and decent work, the article highlights that, in general, such rights are not implemented. Thus, it seeks to contribute to the development of assertive measures, aimed at ensuring a safer working environment focused on teacher health.
