Abstract

The theoretical analysis carried out in this article focuses on objective good faith, the social function of contracts, and the protection against redibitory vices, studied from different Brazilian legal diplomas. These three elements have undergone numerous transformations over time. These transformations are part of a long process of state legal intervention in individual relations. In current Brazilian law there is a tendency to analyze individuals as having different economic, political and social capacities. This tendency has led to the search for a Justice that is dedicated to fighting for the common good and equity in institutional relations.

Rodrigo do Prado Bittencourt, Universidade de Coimbra

Possuo graduação em Ciências Sociais (USP, 2007), mestrado em Teoria e História Literária (UNICAMP, 2013) e doutoramento em Literatura de Língua Portuguesa: Investigação e Ensino (Universidade de Coimbra, 2017). Sigo a linha de estudos que contempla as relações entre Literatura e Sociedade. Publiquei mais de 30 artigos acadêmicos; em seis países: Alemanha, Brasil, Chile, Estados Unidos, França e Portugal. Sou membro do corpo editorial de nove revistas acadêmicas (sendo duas estrangeiras), leciono há mais 10 anos e tenho publicado contos em diversas revistas de arte.
