BOAS PRÁTICAS NO COMBATE À VIOLÊNCIA OBSTÉTRICA
Abstract
The idea of this research project is, besides presenting and discussing the problem of obstetric violence, to understand it from the legal point of view, using several principles such as the dignity of the human person, equality, the right to maternity and of the very right to life. However, it will also be an analysis under the medical sciences, since the intention is to deal with the subject in an interdisciplinary way. The analysis, based on bibliographic methods, literature review, case study and hypothetico-deductive, should reach unlimited results, since, despite the absence of a specific law, humanized childbirth is already a subjective right fully guaranteed by the legal system Brazilian. The objective of this work is to deepen the theme of gender issues under both eyes - medicine and law, promoting the debate about the importance of the role of women as the protagonist of their own choices, their biological individuality and, finally, the use of scientifically backed procedures. In this sense, it is hoped that by encouraging the scientific discussion on the humanization of childbirth, there will be a re-signification and recognition of pregnant women as active subjects of law and that it be exercised not only in private health, but also, fully, in the public health.
