SOCIAL PROTECTION AND THE ISSUE OF SOCIAL SECURITY IN BRAZIL: ANALYSIS ON THE POSSIBILITY OF ADDITIONAL EXTENSION OF 25% OF DISABILITY RETIREMENT TO OTHER RETIREMENT MODES

Abstract

This article aims to investigate the possibility, as well as the possible limits of extension of the additional 25% of disability retirement to other pensions granted in the General Regime of Social Security (RGPS) in Brazil. To this end, a theoretical and practical analysis is carried out on this issue, considering the basic principles of national welfare law against the suspension granted by the STF to PET 8002 that deals with the subject. Subsequently, an overview of social protection against the source of social security funding in Brazil is presented, listing the main challenges, perspectives and practical impasses for the possibility of extending this additional to other types of retirement.
