The PROTAGONISM, JUDICIAL POWER AND DEMOCRACY: REFLECTIONS AND SINGULARITIES IN CONTEMPORARY SOCIETY
Abstract
This article deals with the protagonism of the Judiciary in the last decades, as well as decisions that can be considered activists. With the Democratic Rule of Law established by the 1988 Constitution, the Judiciary came to face issues that were not up to it until then and its decisions implied a protagonism, that is, a looming by this power, deciding issues, that sometimes exceed the limits of your sphere. From these considerations will be built the work, against the background, decisions that have impacted on society in general and that can be considered activists by the legal community and the implications on democracy. The theme is relevant in the Brazilian scenario where the Supreme Court acts acting sometimes as Legislative Power. The method used is deductive.
