Abstract

The general objective of this research is to analyze the relation of decolonial thought and Latin American neoconstitutionalism, as well as the presence of these new paradigms in contemporary Brazil (after 1988). The specific objectives are to demonstrate some aspects of the colonization of America and of decolonial thought and then describe the new constitutionalism that emerged in Latin America from the 1990s. The research problem to be faced concerns the attempt to respond to your overall goal. It is a bibliographical research, with contributions in books, articles, periodicals, laws, of national and international authors. It remains to be seen that decolonial thinking has a relation with the new constitutionalism of Latin America, since there are positivation of these rights in the legal system, and that in Brazil today it is possible to perceive the presence of these new paradigms considering that the Federal Constitution in force protects the life of all beings, the cultural diversity of all peoples, their social and political organizations, recognizing that it is a multicultural country.
