DISCRIMINAÇÃO INTERSECCIONAL - RACIAL E DE GÊNERO: UMA ABORDAGEM SÓCIOJURÍDICA DA SITUAÇÃO DA MULHER NEGRA NO BRASIL

Abstract

All forms of violence against women have been disseminated in the media, pointing to state and social unrest in the face of gender violence in the country. Violence that originates in the formation of the society that naturalized the woman as object of possession and submission to the patriarchal system. Violence against black women in Brazil is considerably higher, as it suffers gender and racial violence. The research analyzed this situation, from the perspective of Intersectional Theory, as a transdisciplinary theory, which considers identity analysis and social inequalities, considering the intersection of race, class and gender, aiming to promote a new model of society. It has investigated whether gender-based violence is the result of racial violence, as well as the national and global legislative apparatus for protecting women. She concluded that when it comes to black women, legal protection is incipient, because it is necessary to combat intersectional discrimination as a cause of violation of the dignity and physical integrity of women, in order to guarantee effective solutions, based on laws associated with inclusive and productive public policies. The research used the hypothetico-deductive method, backed by books, scientific articles, legislation and institutional websites.
