THE CONSTITUTION IN DEFENSE OF INDIGENOUS PEOPLES: THE RIGHT TO HEALTH IN PANDEMIC TIME
Abstract
This article seeks to highlight, even if briefly, the importance of the 1988 Constitution for Brazilian indigenous peoples in the face of all the problems faced, highlighting the right to health. To achieve this end, the dilemma of the process of coloniality, exploitation and exclusion in Brazil is first faced in relation to its native peoples. Then, it seeks to understand the rights of indigenous peoples in the 1988 Constitution, in order to finally verify the right to health and the challenges of indigenous peoples in times of pandemic. In conclusion, the Brazilian constitutional document is the safe haven of indigenous peoples. With regard to the right to health, the Constitution was established among the fundamental rights, remaining that all are holders of that right, especially in times of pandemic, where the quality of care for indigenous people is urgent to guarantee their well-being and their biological and cultural survival.
