JUDICIAL REVIEW AND RULE OF LAW: CONSIDERATIONS ABOUT THE (IN)ADEQUACY OF PROCEDURALIST THESIS TO BRAZILIAN LAW
Abstract
This article aims to analyze the applicability of procedural theses to the Brazilian constitutional structure. To achieve this end, the book “democracy and distrust” by John Hart Ely was chosen as a representative of this theoretical current. This choice, however, was not discretionary. It is based on the fact that Ely's work was one of the first theoretical efforts to explain and limit the activity of the US Supreme Court. In addition, the text has a strong influence on later writings that can be considered procedural, including within the scope of Brazilian constitutional theory. For the analysis proposed in this article, Ely's text was related to the characteristics of Brazilian constitutionalism. Conclusively, the inadequacy of procedural theses to Brazilian law was verified.
