The repercussions of pejotização in the labor field in the Brazilian legal system

Abstract

The article proposes to analyze the phenomenon of pejotização in the Brazilian legal system, because in order to meet the desires of capital, the need arose to lay bare the employability or hiring of workers. In view of this, from a competitive labor market, it is possible to observe a growing practice that aims to circumvent labor legislation, the so-called “pejotização”, with it, several rights are suppressed, masking a true employment relationship. As every action generates a reaction, the act of defrauding the law also suffers several consequences, implying the worker and his employer reflexes in the labor and social security field, making the practice of the phenomenon a long-term problem. The methodology used was the bibliographical research, based on legal material, with motto in the reflections of the pejotização in the labor field.
